Terms and Conditions of Service and Guarantee
GENERAL TERMS AND CONDITIONS OF SERVICE AND GUARANTEE POLICY
Hiring and carrying out any service by RapiPlaga S.L. implies full, unconditional and unreserved acceptance of these General Conditions, as well as of the specific conditions set out in the Treatment Certificate and Work Report given to the customer.
1. INVOICING AND PAYMENT CONDITIONS
One-off services: the full amount of the service must be paid, without exception, at the end of the first technical visit.
Special treatments and maintenance: treatments against wood-boring insects (termites/woodworm) and maintenance contracts for businesses (B2B) are governed by the payment, instalment or financing conditions set out in their specific contract.
2. APPLICATION AND VALIDITY OF THE GUARANTEE Any commercial guarantee is subject to strict compliance with the following requirements:
The service must have been paid in full.
The customer must have applied all the corrective measures (physical, structural, hygiene and behavioural) indicated by the technician.
The guarantee only covers the pest species originally treated. It does not cover secondary or newly appearing pests.
The duration, number of follow-up visits and any call-out charges for unfounded or premature visits will be set out in the specific Treatment Certificate for each service.
Exclusion for high-turnover sectors: unless there is an annual comprehensive maintenance contract in force, one-off treatments in high-exposure sectors (hospitality, tourism, transport, logistics and food) are not guaranteed against re-infestation, due to the constant flow of goods and people.
3. EXEMPTION FROM LIABILITY AND BIOSAFETY
Safety periods: it is compulsory to respect the vacating and ventilation periods and the preventive measures indicated by the technician and current regulations. RapiPlaga S.L. accepts no liability for any adverse health effect resulting from the customer’s failure to comply or negligence in this respect (including the premature return of pets).
Reactions in materials: although the biocides used are strictly approved, in exceptional cases they may react with certain dyes, plastics, varnishes, enamels or textiles. RapiPlaga S.L. accepts no liability for cosmetic changes or unforeseeable deterioration of such materials.
Wood treatments: in treatments against wood-boring insects, the company accepts no liability for structural damage that the pest may continue to cause during the eradication process, as biocides and baiting systems need a long physiological period to be fully effective.
Building work and access: restoring architectural elements to their original condition after test openings, openings or handling of false ceilings needed to reach the sources of infestation is not covered.
4. UNILATERAL CANCELLATION OF THE GUARANTEE RapiPlaga S.L. reserves the right to cancel any guarantee immediately, with no right to a refund or compensation, in the following cases:
Third-party interference: tampering with the treatment, simultaneous use of household biocides, or intervention by another company or professional outside RapiPlaga S.L.
Negligence: acts of bad faith, obstruction of the technical work, flagrant failure to maintain the required hygiene levels, or if the source of infestation comes from adjoining areas outside the treated area.
Improper behaviour: any lack of respect, threat, extortion, or verbal or physical aggression towards our technical, administrative or management staff.
5. DISPUTE RESOLUTION AND GOOD FAITH CLAUSE The business relationship is governed by the principle of good faith. The customer accepts that using digital platforms to make defamatory accusations or harmful reviews – motivated by the loss of a guarantee due to their own documented breaches (non-payment, lack of hygiene, failure to respect safety periods) – constitutes a breach of that good faith. RapiPlaga S.L. documents all its interventions and reserves the right to refer any attempt at coercion to its legal advisers in order to claim compensation for financial and reputational damage.
The company reserves the right to modify these conditions at any time to adapt them to current health and hygiene regulations.
